Severance of Joint Tenancy (Form A)
How InLeef builds the HM Land Registry Form A application to sever a joint tenancy so a property is held as tenants in common.
This is the HM Land Registry application (Form A) to record that a jointly-owned property is now held as tenants in common rather than joint tenants - a common step when setting up a property trust. It's its own document, separate from a will, and you can add more than one to an order (for example for different properties).
What you'll fill in
| Section | What you set | Notes |
|---|---|---|
| Applicant(s) | The registered owner(s) applying to sever - one or two people. | Add both where both owners apply together. |
| Property | The property, the local authority for its council tax, and its Land Registry title number(s). | Title numbers must match the register exactly. |
| Payment | The application fee (if any) and how it's paid - Direct Debit or cheque. | Leave the fee blank where none is payable. |
| Evidence of severance | How the severance is evidenced (see below). | Defaults to "application by all the owners". |
| Sent to Land Registry by | The person or firm lodging the application - name and address are required, plus optional DX/key number, reference and contact details. | - |
Evidence of severance
| Option | What it means | Follow-up |
|---|---|---|
| Application is by all the registered owners (default) | Both owners are applying - no further evidence needed. The usual route. | none |
| Severance is by a document signed by all the owners | A signed severance document exists. | Say whether it's enclosed or your firm certifies holding it. |
| Notice of severance has been served | A notice was served on the other owner(s). | Pick which proof of service applies. |
The follow-up choices clear automatically if you change the main option.
Good to know
